  • Tenders are invited for Consultant to Strengthen the Capacities of Specialized Law Enforcement Officials to Combat Online Sexual Exploitation and Abuse of Chidlren in Albania. For every child, Child Protection UNICEF Country Office (CO) in Albania recognizes the strong linkage existing between children's rights and internet safety. Being a country with the lowest internet connection rates in Europe in the recent past, Albania has witnessed a substantial rise in internet utilization, especially among the young population. Internet provides tremendous opportunities for personal development, but also can reinforce inequities among children and lead to harmful consequences and risks to their safety and well-being (online bullying, harassment, sexual exploitation, etc). Therefore, UNICEF will provide continues support to the Government of Albania and involved stakeholders to establish and operationalize strategies and policies to strike a balance between providing access to modern internet communication technologies and the benefit they offer to children and young people, while minimizing risks and potential harm, making the Internet a safer place for all. During past years, UNICEF CO succeeded in initiating a number of fundamental shifts in the Albanian legislative, institutional and technical capacity base, with a view of enhancing the national response to the harmful phenomena of child abuse and sexual exploitation in the virtual space. UNICEF's key role in advocating, lobbying and assisting the Government of Albania's participation in the Abu Dhabi Summit on Child Sexual Exploitation and Abuse (CSEA) facilitated the countries commitment to the Declaration and Principles of Action by the Governments adopted at the Summit. UNICEF Albania's multi-year project 'Safer and Better Internet for Children in Albania' which started in May 2017, funded by the Global Partnership to End Violence against Children, is geared towards comprehensive response to children's online sexual exploitation and aims to support the implementation of the National Action Plan for a safer internet for children in Albania. UNICEF has undertaken significant interventions including: bringing about solid evidence based understanding of children's usage of internet; comprehensive assessment of legal, normative and institutional frameworks as well as available human resources; consolidating and completing legal acts for children with bylaws to guide the implementation of legal provisions; enhancing cross sectorial collaboration between government - civil society organizations - industry; building key stakeholders capacities in preventing and responding to violence online cases; supporting children, adolescents and youth to act as peer educators and change makers. UNICEF Albania's 2018 study on "Children's Experiences of Internet Use in Albania" already produced some key preliminary findings, revealing that children: § Increasingly have access to the internet and social media platforms at a younger age (9 years and lowering); § Utilize social media and web-based platforms similarly as their peers in other European countries - YouTube (72%), Instagram (58%), Facebook (50%), and WhatsApp (49%); § Reported being upset from something that happened to them online (14%); § Nearly 1 in 10 had unwanted sexual experience online; § Met someone in person that they never knew before (16%); § 2 in 5, received hateful or degrading messages directed to them; § 1 in 4, has a stranger as a friend in one of the social media platforms. Besides the study, UNICEF also commissioned in 2018 the national assessment on the legal, institutional framework and human resources in place to address violence against children online. Though the report pending finalization, what has already surfaced clearly indicates a range of shortcomings, hampering effective investigation of child online sexual exploitation and abuse. Moreover, the admin data from the State Police shows that in 2017 only a few cases of crimes committed online, involving children as victims or offenders, were reported to the police and even fewer reached the court. Lastly, the assessment found numerous bottlenecks that are hampering online abuse victims/cases identification; Lack of technological infrastructure in the law enforcement offices; Lack of adequate human resources and tools; Challenges to access needed data stored by the Internet Service Providers; Overall lack of coordinated work within and outside the law enforcement sector. How can you make a difference? While the legal framework around child protection is relatively new and advanced, there is an immediate need for specific technical support, as well as necessary hardware and software upgrade of the law enforcement sector (Sector for the Investigations of Computer Crimes) to identify, manage and properly investigate the cases of online child abuse and exploitation. However, taking into consideration that addressing online safety of children is relatively new area in Albania, there is a gap in the availability of highly specialized expertise. UNICEF and Ministry of Interior are spearheading this work however other important line ministries and agencies are on board, such as Ministry of Health and Social Protection; Ministry of Education, Youth and Sport; Ministry of Justice as well as National Authority for Electronic Certification and Cyber Security and State Agency for Child Rights and Protection. The purpose of this consultancy is to assist the Sector for the Investigations of Computer Crimes in enhancing their investigative response to online sexual exploitation and abuse. The objectives of this consultancy are to: § Conduct a needs assessment of specific gaps in terms of the needed equipment, human resources, skills and capacities of the Sector for the Investigations of Computer Crimes of the Albanian State Police; § Develop a comprehensive plan to address the findings of the assessment, including the specification of the needed equipment and technological solutions; § Develop Standard Operating Procedures of the Unit in relation to the workflow for dealing with forensic evidence, investigation process and case referrals; § Conduct training of the staff of the specialized Sector for the Investigation of Computer Crimes based on the needs of the sector; Approximately 20-25 professionals based across the country. The consultant will cover the following non-exhaustive list of tasks: § Conduct a desk review of all relevant national legislation, policies related to children's protection online, data and other documentation on the prevalence of child sexual abuse and exploitation; § Conduct needs assessment of the needed equipment, technological solutions, human resources, skills and capacities of the Sector for the Investigation of Computer Crimes; § Develop specific recommendations for the strengthening of the work of the Sector for the Investigations of Computer Crimes to address online CSEA effectively. This will include human and structural recommendations, organization of the unit, referral pathways, documentation and reporting. § Present recommendations about professional, technical and technological requirements needed for quality investigation of online child abuse and exploitation; § Develop standard operating procedures, in consultation with relevant state officials, for the work of the Sector for the Investigations of Computer Crimes, working practices that adhere to the international standards, investigation processes, case referrals and work relations with other sectors within the Albanian State Police and entities outside the institutions such as civil society organizations, industry, international entities, etc. § Develop training materials for the staff of the of the computer crimes sector reflecting findings of the assessment § Coordinate with relevant state officials and UNICEF on the needed logistics for conducting the on-site training course; § Conduct on-site training course of the staff of the computer crimes sector to develop their capacities on SOP's and best practices on the examination and use of specialized equipment; Deliverable 1: Assessment report of the specific gaps in terms of the needed equipment, technological solutions, human resources, skills and capacities of the Sector for the Investigations of Computer Crimes of the Albanian State Police. Tasks: § Desk review; § Face-to-face interviews with all relevant informants; § Present preliminary findings to UNICEF, Albanian State Police/Ministry of Interior Duration: 10 working days (3 offsite and 7 onsite in Albania) / Consultant with the support from UNICEF Child Protection team Completion date: within one month from contract signing Deliverable 2: Comprehensive set of recommendations addressing the findings of the assessment, including the specification of the needed equipment and technological solutions; AND Standard Operating Procedures and workflow for dealing with: a) forensic evidence; b) investigation process; c) case referrals. (This are only indicative titles and may change after the assessment is conducted) Tasks: Draft recommendations in consultation with the key relevant state bodies and UNICEF; § Include in the plan all technical and technological requirements needed for quality investigation of online child abuse; This must include the technical specifications of equipment, software, licenses, etc. § Draft SOPs Duration: 4 working days (offsite) / Consultant C
